         When a minor or incapacitated person is involved in a personal injury case and a settlement is proposed, a Settlement Guardian ad Litem must be appointed to represent the interests of the minor or incapacitated person.  The Settlement Guardian ad Litem thoroughly investigates the case, to determine whether the settlement amount is fair and reasonable.  The Settlement Guardian ad Litem must be an experienced attorney and must prepare a detailed report and advise the Superior Court Judge regarding the specifics of that particular case, any unusual factors to be considered, legal issues, and the fairness of the settlement.
