to Areas of Practice Mediation is a process used to enable people who have differing positions achieve agreements. It is a relatively inexpensive and much less risky alternative to a trial. In mediation, the participants make their own decisions; in trial, the judge makes the decisions. The mediator is an objective professional who has no connection to the participants. At McPHERSON & McPHERSON, Joan McPherson does the majority of mediation cases. Her experience as a lawyer and a Superior Court Judge gives her extra insight into the legal process and what the parties will face at trial. Her goal is to have a positive conclusion at the end of the mediation. The mediation process is low key. The opposing parties do not necessarily have to address each other - each party can talk privately and confidentially to the mediator. The mediator does not make the decisions - the participants make their own decisions, and if one party does not agree, there is no agreement on that particular issue. Perhaps it can be worked out later on. Other issues are addressed. The mediation atmosphere is casual but professional.
